4. Online Advertising and Analytics
We use a variety of online tracking and analytics tools (e.g., cookies, pixels, tags, and web beacons) to collect and analyze information as you use the Services. Among other things, these technologies allow us to offer you a more tailored experience by understanding and remembering your particular browsing and usage preferences. We may also use third-party web analytics services (such as those of Google Analytics) on our Services to collect and analyze information collected through these technologies to assist us in auditing, research, or reporting; fraud prevention; and providing certain features to you.
The primary types of tracking and analytics tools we and our vendors use for these purposes are:
Cookies, which are small data files stored on your computer or device to collect information about your use of the Services. Cookies may enable us to recognize you as the same user who used our Services in the past, and relate your use of the Services to other information we have about you. Cookies may also be used to enhance your experience on the Services (for example, by storing your username) and/or to collect general usage and aggregated statistical information. Most browsers can be set to detect cookies and give you an opportunity to reject them, but refusing cookies may, in some cases, limit your use of our Services or features. Please note that by blocking, disabling, or managing any or all cookies, you may not have access to certain features or offerings of the Services.
Pixel tags (also known as a “clear GIF” or “web beacon”), which are tiny images that can be placed on a web page or in our electronic communications to you in order to help us measure the effectiveness of our content by, for example, counting the number of individuals who visit us online or verifying whether you’ve opened one of our emails or seen one of our web pages.
Subject to consent elections you have expressed to us, we use these technologies for the delivery of relevant content and advertising on the Services, as well as on other websites you visit and other applications you use. The ads may be based on various factors such as the content of the page you are visiting, your activity on the Services, and other information we collect from you. These ads may be based on your current activity or your activity over time and across other websites and online services and may be tailored to your interests.
Subject to your consent preferences, we also allow other third parties (e.g., ad networks and ad servers such as Google and others) to serve tailored ads to you on the Services, other sites, and in other applications, and to access their own cookies or other tracking technologies on your computer, mobile phone, or other device you use to access the Services. We sometimes provide our customer information (such as email addresses) to partners who may “match” this information to their information in order to advertise our services on third-party platforms, like social media networks.
If you are interested in more information about tailored browser advertising and how you can generally control cookies from being put on your computer to deliver tailored advertising, you may visit the Digital Advertising Alliance’s Consumer Opt-Out link to opt-out of receiving tailored advertising from companies that participate in those programs. To opt out of Google Analytics for display advertising or customize Google display network ads, visit the Google Ads Settings page. You can also review the cookie preferences settings for your browser or mobile device to learn more about your choices for controlling cookies and similar technologies. We do not control these opt-out links or mechanisms, or whether any particular company chooses to participate in these opt-out programs. We are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms. Please note that these opt-outs apply per browser and per device, so you will have to opt out for each device—and each browser on each device—through which you access our Services.
Please note that if you exercise the opt out choices above, you may still see advertising when you use the Services, but it may not be tailored to you based on your online behavior over time.
5. Information Retention
We will only keep your personal information for as long as necessary to fulfill the purposes for which we collected the information, as described in this Privacy Policy, unless a longer retention period is required or permitted by law (for example, for tax, accounting, or other legal requirements).
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize your information, or, if this is not possible (for example, because your personal information has been stored in backup archives), we will securely store your personal information and isolate it from any further processing until deletion is possible.
6. Your Rights and Choices
6.1. Newsletters and Promotional Emails
We may use your e-mail address or other methods to send you newsletters and messages about new Site features, special offers, promotional announcements, consumer surveys, and other correspondence concerning our Services. If you no longer want to receive marketing promotions from us, simply manage your preferences in your Account. If you no longer want to receive email marketing from us, click on the UNSUBSCRIBE link in our email communications. Please note that you cannot unsubscribe from certain correspondence from us, including messages relating to your Account transactions.
6.2. Rewards Programs, Contests, Etc.
The Services may offer opportunities to receive certain benefits such as discounts or free or extended services which California may consider to be a financial incentive or certain loyalty programs that may qualify as a “financial incentive” under California law or “bona fide loyalty program” under Colorado law. In such a case, your request may not be fulfilled.
Some Services can only be provided if we have your information, therefore deletion of your information will result in termination of such Services.

If you are a resident of one of the US states listed in Section 6.3. above, you also have the right to opt out of “sales” of your information and “sharing/processing of your information for targeted advertising.”
As explained in the “How We Disclose Your Information” section above, with your consent, we may disclose information to third-party advertising and related analytics providers for targeted advertising purposes. This allows us and our partners to provide you with more relevant and tailored ads, or use analytics partners to assist us in analyzing use of our services and our user/customer base. These disclosures may be considered a “sale” of personal information under applicable law, or the processing/sharing of personal information for targeted advertising purposes. The personal information we disclose for these purposes includes device and network identifiers, internet or other electronic network activity information, commercial information, and inferences drawn from this information.
Please note that we do not disclose personal information that may be considered “sensitive” or “special category” information under applicable law for these purposes without your consent.
If you would like to opt out of sales of personal information or processing for purposes of targeted advertising, please visit the “Your Privacy Choices” page, which can be found in the footer of each site, linked here for NFHS Network. In our mobile app, please visit the “Your Privacy Choices” option within the mobile app settings menu. If you are not logged in, you must make this choice on each site/app on each browser/device you use to access the Services. You must also renew this choice if you clear your cookies or your browser is set to do that. You can also submit a request to opt out of our non-cookie-based processing for targeted advertising by completing the form available at the link above. Depending on your jurisdiction, you may be permitted to designate an authorized agent to submit such requests on your behalf. Please note that we do not knowingly sell the personal information of minors under 16 years of age without legally-required affirmative authorization. If you have a legally-recognized browser-based opt out preference signal turned on via your device browser, we recognize such preference in accordance with applicable law.
7. Security
We use various physical, technical, and administrative safeguards to help protect the personal information submitted to us. Unfortunately, no security system can be 100% secure. Accordingly, we cannot guarantee the security of your information and cannot assume liability for improper access to it.
You are responsible for maintaining the confidentiality of your Account access information and for restricting access to your computer or device through which you access your Account. If you disclose your password to anyone or share your Account and/or devices with other people, you take full responsibility for their actions.

We also comply with other age restrictions and requirements in accordance with applicable local laws.

Each of these rights is subject to certain limitations and exceptions under applicable law. For example, we need certain information to provide our services to you, so we may deny a deletion request for that information while providing services to you.
To request to exercise any of these rights and receive the fastest response, you or your agent can access our privacy webform at this link, email us at privacyrequests@playonsports.com, or contact us. 10.5. Shine The Light
The California “Shine the Light” law gives residents of California the right under certain circumstances to request, on a yearly basis, information about our disclosure of certain categories of “personal information” (as defined in the Shine the Light law) to third parties for their own “direct marketing purposes” (as defined in the Shine the Light law), or in the alternative, that we maintain a policy of providing a cost-free means for consumers to opt out of any such disclosure. We maintain a policy to allow consumers to opt out of such disclosures. You can exercise this right by emailing us as directed in the CONTACTING US section below with the subject line “Shine the Light Request”.
